Payment and Delivery Terms

These Payment and Delivery Terms (the "Terms") set out the procedure for paying for services and receiving the digital product (a QR code / activation code for an eSIM profile) in the ESIMKA service, available at https://esimka.io and provided by Kolofi LLC, Legal Form: Limited Liability Company, Identification Number: 402285424, Registration Number and Date: 26/07/2023, Registering Authority: LEPL National Agency of Public Registry (Georgia), Registered Office Address: Georgia, Tbilisi, Didube district, Archil Kurdiani street, N16, apartment N12. These Terms form an integral part of the Public Offer.

1. Payment Methods

Payment for services is made in cashless form by the following methods:

  • bank cards of international payment systems (Visa, Mastercard, JCB, UnionPay and other supported cards) through an acquiring bank or payment processor;
  • payments by QR code or payment link, where available;
  • Telegram Payments (in the Telegram bot);
  • electronic wallets and other alternative payment methods connected to the payment processor;
  • other methods available in the Service interface at the time of placing an order.

All payments are processed by certified payment processors, acquiring banks or other authorized payment service providers in accordance with applicable security standards, including PCI DSS where applicable. The Provider does not receive, store or process the Customer's full bank card details.

2. Currency and Prices

Prices in the Service are shown in the currency selected by the Customer or otherwise displayed at checkout. The final amount payable, applicable taxes (if any), payment fees and currency conversion information are shown before payment is confirmed. Where a price is displayed in an additional currency for reference, the final amount payable is determined at checkout.

The Provider may change prices unilaterally; a changed price does not apply to orders that have already been paid.

3. Payment Procedure

3.1. The Customer selects a plan and clicks the "Pay" button.

3.2. The Customer is redirected to a secure page of the payment processor.

3.3. After successful payment, the Customer receives a notification in the Telegram bot and/or by email.

3.4. If the issuing bank or payment service refuses the payment, the Customer is advised to check the card data, available balance and limits, and contact the issuing bank or payment service provider.

4. Delivery Terms

4.1. The eSIM profile is an electronic digital product and is delivered to the Customer remotely by sending a QR code or activation code to:

  • the personal account in the Telegram bot @esimka;
  • the personal account on the website, where registration is available;
  • the email address specified when placing the order.

4.2. Delivery time is from 1 (one) to 15 (fifteen) minutes after payment is received; in exceptional cases, up to 24 (twenty-four) hours.

4.3. Physical delivery by courier or post is not performed, because the eSIM profile is an electronic product.

4.4. The risk of loss of the QR code after delivery passes to the Customer. Re-issuance of the QR code is possible only before it is activated.

5. Receipts and Payment Confirmations

5.1. For each successful payment, the Provider and/or its payment processor may generate an electronic receipt, payment confirmation or other payment record in accordance with applicable law and the rules of the relevant payment system.

5.2. The electronic receipt or payment confirmation is sent to the Customer to the email address and/or phone number specified during payment, or is made available by the payment processor.

5.3. If a duplicate receipt or confirmation is required, the Customer may contact support.

6. Refund Currency

A refund is made in the same currency in which the payment was made and to the same payment instrument, unless otherwise agreed with the Customer. Refund terms are set out in the Refund Policy.

7. Payment Security

When paying by bank card, 3-D Secure (3DS 2.0) or another authentication mechanism may be used where supported by the issuing bank and the payment processor. Card data is entered on the side of the acquiring bank or payment processor and is not transferred to the Provider's infrastructure. Suspicious transactions may be monitored by anti-fraud systems of the acquiring bank and payment processors.
